Acquisition, extinction and loss of subjective dcho

A legal right when it is born and can occur with or without the intervention of human will. Eg a donation.
Therefore, the
acquisition of a subjective dcho is the union of dcho concerned with the person of its owner, being very different modes of acquisition of a right which may be due to natural events (fruit harvest) or by acts human, through legal transactions.

Consequently, we can differentiate with respect to the acquisition of dchos, enter:
a) Purchase original: it is produced from scratch, ie it is a new dcho holder previously lacking.
b) Derivative acquisition:
this is when you buy a dcho after someone exercised. The derivative acquisition involves the loss of dcho by the former incumbent and its acquisition by the new owner.

As for the
extinction of dcho subjective, means the complete disappearance of a dcho without another come to occupy the position holder, ie with no other person one to replace the previous incumbent. Therefore, the extinction of a dcho will mean the absence of it. The cases of disappearance of a dcho usually occur on the death of the holder.

However, we must differentiate between this extinction dcho and simple loss of it, since the loss of a RH only leads to the disappearance of the owner, but the RH is not extinguished, but will remain for another owner after it acquired.
A very important case of loss of RH is the resignation of a dcho which means voluntary withdrawal by the holder thereof without transmitting the RH in question., Ie the owner does not want dcho. Hence the
Art. CC 6.2 comes to pointing out that opting out of the applicable law and the renunciation of dchos recognized therein apply only when not contrary to the public interest or no harm to others. However, there are waived as dchos p . eg the personality and, in our case, the surrender of a dcho is irrevocable and has to formulate a clear and decisive.
